The Press Are Not Guardians of the Galaxy

There are many freedoms which are cherished in the United States, as outlined in the Bill of Rights. These freedoms were specifically enumerated to curtail the power of the government. Key provisions reserved for individuals can be found in the very first of the ten amendments made to the U.S. Constitution:

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”

Individuals were given the right to speak their minds, to associate with people of their own choosing and to publicly write and disseminate materials without government interference. The government was specifically limited in forcing upon people a particular narrative.

That was in 1791.

Several items have changed the way Americans and (much of the world) view these key principles of freedom:

  • The Internet and social media have enabled people to have platforms which can reach every corner of the world, making each person potentially more influential than the mainstream media
  • The mainstream media’s business model has been collapsing as money from classifieds and advertising abandoned the press for those new media platforms like YouTube, Facebook and Twitter with greater reach, driving the remaining corporate media titans to become more partisan and inflammatory in their content to retain and attract viewership
  • Social media is not simply a soap box nor bulletin board, but includes a range of sophisticated algorithms which direct viewers towards a prioritized list of media to consume, making the platforms themselves powerful disseminaters of information

These first three points are critical to understanding the tension between the democratization of the press: how large media companies backed by large corporate advertising dollars are dissolving in the face of smaller and more niche sources of media. Those smaller media sources can survive as hobbies of individuals and can attract micro-audiences and some actually become larger than the historic media agencies.

Against this democratization of the press which has unfolded over the past two decades is the growth of global terrorism:

  • History has shown (the Holocaust) how propaganda can quickly descend into a genocide of innocent people prompting the introductions of hate speech laws which inherently limit free speech
  • World leaders and the press have presented their case that leading global terrorist organizations like the Islamic State and al Qaeda effectively recruited individuals online, and have pushed the social media platforms to remove the content of those organizations
  • Governments have similarly asked the social media platforms to alter their algorithms to intersperse a range of ideas to people who may be searching for niche extremist ideas

Lastly, in addition to the democratization of the press and growth of terrorism prompting governments to intervene in the business of social media, is the more general backdrop of society and how social media is currently used:

Taken together, governments and global organizations are infringing on many freedoms in the stated desired hope of promoting a more peaceful and inclusive society.

It sounds noble as a goal and problematic in practice. Limiting speech that incites violence is logical and lawful, but calling non-violent speech a form of illegal “microaggression” is an assault on the First Amendment. Perhaps a person could get over a very limited number of restrictions if the world would indeed become more peaceful. Perhaps, but that is beside the point here.

The issue is that the limitations on individual speech and associations online are being advanced while the mainstream media is becoming ever more inflammatory and biased. The dynamic that governments were held in check by a free press in a balance of power with the press acting as a guardian of the people is a principle which may have had a shelf life from 1791 to 2000, but no longer applies in a world where the people’s voices are just as loud.

Consider two statements made by the United Nations Secretary General António Guterres over the last few days:

On social media contributing to hatred and violence: “Around the world, we are seeing a disturbing groundswell of intolerance and hate-based violence targeting worshipers of many faiths. In recent days alone, a synagogue in the United States and a church in Burkina Faso have come under attack….

Parts of the Internet are becoming hothouses of hate, as like-minded bigots find each other online, and platforms serve to inflame and enable hate to go viral. As crime feeds on crime, and as vile views move from the fringes to the mainstream, I am profoundly concerned that we are nearing a pivotal moment in battling hatred and extremism.

That is why I have set in motion two urgent initiatives: devising a plan of action to fully mobilize the United Nations system’s response to tackling hate speech, led by my Special Representative on Genocide Prevention; and exploring how the United Nations can contribute in ensuring the safety of religious sanctuaries, an effort being led by my High Representative for the Alliance of Civilizations.”

On Freedom of the Press:A free press is essential for peace, justice, sustainable development and human rights. No democracy is complete without access to transparent and reliable information. It is the cornerstone for building fair and impartial institutions, holding leaders accountable and speaking truth to power….

When media workers are targeted, societies as a whole pay a price. On World Press Freedom Day, I call on all to defend the rights of journalists, whose efforts help us to build a better world for all.

The concepts that the head of the U.N. put forward taken together are ancient: the press is no longer the vehicle for “transparent and reliable information.” It is as jaundiced and bigoted as social media. Protecting the press while quashing social media would be the opposite of speaking truth to power; it would be empowering the press at the expense of the people, not in favor of the people.

Consider the leading mainstream media organization The New York Times. It’s portrayal of the Israeli-Arab Conflict is beyond biased. It posts articles and cartoons vilifying Jews and the Jewish State over and again while it whitewashes the antisemitism of Palestinians. Should the bigots of The NY Times control the narrative while individuals on social media explaining Muslim antisemitism be silenced? Who gets to decide if liberal or conservative ideas have a right to be shared or censored?

Journalists are no longer limited to the large press organizations but can be found throughout social media. Their rights must be defended as vigorously as any.

A free press without free speech for all would be a tyranny of the worst sort.

Journalists Killed in 2016 #AlternativeFacts

There were several dozens of journalists killed around the world in 2016. The exact number seems hard to pin down.

According to UNESCO, 101 journalists were killed. It considered Syria as the most dangerous country for journalists, and elaborated that “the most lives were lost in the Arab States, where the armed conflicts in the Syrian Arab Republic, Iraq and Yemen have claimed the largest share. Media operating in Latin America and the Caribbean saw 28 casualties, including bloggers and freelancers, constituting the region as second deadliest in 2016.

However, the International Federation of Journalists (IFJ) counted 93 journalists as targeted and killed. They note that another 29 were killed in accidents or natural disasters bringing the total to 122. IFJ listed the most lethal country for journalists as Iraq (15 killed) followed by Afghanistan (13). Syria ranked as  #6 with 6 killed.

Meanwhile, Reporters Without Borders (RSF) tallied 74 journalists murdered, including non-professional “citizen-journalists.” RSF tagged Syria as the deadliest country. “Syria continues to be the world’s deadliest place for journalists, followed by Afghanistan. Worldwide, two thirds of the journalists killed this year were in war zones. Almost all of them were local journalists, now that news organizations are increasingly reluctant to send their reporters to dangerous hotspots abroad.

The Committee to Protect Journalists (CPJ) announced that 48 journalists were killed in 2016, with clear motives. Syria led the list with 14, followed by other Arab and Muslim countries: Yemen, Iraq, Afghanistan and Libya.

So how many journalists were killed in 2016? 122? 101? 93? 74? 48?

How did four “non-partisan” and “reputable” organizations come to such different conclusions? Did some organization include accidents while others did not? Perhaps one included civilian-journalists and bloggers while another just counted professionals. Maybe some groups did not include peripheral casualties if the journalist wasn’t specifically targeted.

All possibilities. As is bias.

Consider that IFJ has a history of declaring that anyone who self-declares as a journalist is a journalist. So if a terrorist operative used press credentials to infiltrate certain areas to commit murder, that person counted as a journalist by IFJ, but not always by other organizations.

In searching for a reason, maybe one could argue that a higher total of injured journalists heightened the importance of umbrella organizations like IFJ. But that would leave a question of why RSF and CPJ would post such low totals compared to UNESCO.

Maybe the reason for one country getting a higher total was purely innocent. If a Syrian journalist was killed in Turkey maybe one organization listed the murder as happening in Turkey, while another focused on the place where the journalist reported.

Beyond listing the raw “facts,” UNESCO, RSF and CPJ reached conclusions based on those facts that the most lethal country in the world for journalists was Syria, even though IFJ announced that the country wasn’t even in the top five. IFJ stated that the most dangerous place in the world to be a journalist was the Asia-Pacific region, specifically Philippines, Pakistan and India. UNESCO, RSF and CPJ claimed that it is the Arab states.  Which was right?

The IFJ website covers the entire world by region and claims to be devoted to a mission beyond politics. “The IFJ does not subscribe to any given political viewpoint, but promotes human rights, democracy and pluralism.”  But the English site reserves reporting about the Middle East to only be in Arabic – clearly limiting the audience of readers to a narrow segment of the world population. Why would it deliberately produce an entire section in Arabic? To educate the region that it scores the lowest in regards to “human rights, democracy and pluralism?” To make it impossible for non-Arabic speakers to read about the state of journalists in the Arab world?

 

In 2017, the world was intrigued by the term “Alternative Facts,” and reacted to it as if it were a new phantom reality. In truth, people and organizations have always looked at the same situation and extracted DIFFERENT FACTS, not only different conclusions. Sometimes the reasons are apparent and other times not. Often one can see the motivating factors which led to a party extracting and expressing particular facts and conclusions, and there are times when the listener is simply stumped.

Does it make the party sharing the facts a liar? Biased? Uninformed? Maybe, maybe and maybe.

As the consumers of information that is oftentimes murky, seek the source and basis of the “facts,” and don’t only rely on someone’s conclusions.

New York Times Confusion on Free Speech

The attacks on the offices of the satirical magazine Charlie Hebdo in Paris in January 2015 sparked a plethora of articles describing the freedoms of speech and press. The New York Times, like many other media sources, fiercely defended the right of people to offer their opinions, even if such views are unpopular. Despite the clarity of its overall stance, the paper appeared confused about “double standards” in its articles which failed to clarify and distinguish between free speech and hate speech.

In the NY Times lead front page story of January 14 referring to such “double standards”, the paper contrasted the right of Charlie Hebdo to make cartoons of the Islamic prophet Mohammed, to the arrested French “comedian” M’bala M’bala who stated that a Jewish journalist should have been killed in the Nazi gas chambers and that he considers himself like the terrorist who shot and killed four Jews in the Parisian supermarket. Neither clarification nor education was given about the differences and limits of free speech.

The NY Times continued to confuse the public (or itself) in a story the next day by David Carr, which included the following:

  • “Not all the French were reveling in unbridled expression of speech. Dieudonné M’bala M’bala, a comedian who has made highly provocative statements since the shooting at Charlie Hebdo’s offices, was detained as an “apologist for terrorism” for statements he made on his Facebook page that were seemingly in support of one of the attackers.
  • His arrest highlights the fact that one man’s free expression is another man’s hate speech or sedition. In Israel, the conservative Jewish newspaper HaMevaser scrubbed out the German chancellor Angela Merkel from a photograph, along with other female leaders who had participated in a solidarity march in Paris, because photos containing women are considered inappropriate in ultra-Orthodox publications.”

In an effort to educate the Times and its readership, here are three important points to distinguish between various types of speech:

  • Concept versus People
  • Active versus Reactive Incitement
  • Editing versus Censorship

 Concept versus People

A central dividing line between freedom of speech and hate speech has to do with the right to discuss concepts as opposed to the right (and limit) to discuss people. Everyone is free to say anything they want about concepts such as: capitalism, communism, Islam and Buddhism. Whether it is religion or economic theory, each topic is considered a concept worthy (perhaps?!) of discussion and debate in a positive or negative fashion. However, speech can descend into “hate speech” (or libel) which is banned by many countries, if people attack either groups or specific human beings.

For example, Louis Farrakhan, a bombastic anti-Semitic Muslim preacher referred to Judaism as a “gutter religion”. He was not brought up on any charges, despite the hateful speech. Egyptian leader Mohammed Morsi was not prosecuted for calling Jews the descendants of monkeys and pigs, which could have perhaps been classified as hate speech in some countries because he addressed people rather than a religion.

 Active versus Reactive Incitement

A key factor in the distinction of permissible versus prohibited speech revolves around “incitement”. Many countries prohibit speech that incites violence, as does the recent United Nations Resolution 16/18. The UN language:

  • “condemns any advocacy of religious hatred that constitutes incitement to discrimination, hostility or violence, whether it involves the use of print, audio-visual or electronic media or any other means”

The phrase incitement to violence is clear. For example, when an imam in Germany called for killing Jews, that fell under hate speech to incite violence, and the country is now investigating that imam.

However, it is considered completely legal to say things that may involve “reactive incitement”, that is, saying something that may annoy people to the extent that they would use violence. To ban reactive incitement would stifle free speech completely which is what the press sees as the essence of the Charlie Hebdo assassinations. Just because Muslims were insulted by the publishing of cartoons of their prophet, their reaction cannot be the basis to ban that freedom of expression.

Based on the United Nations language, the incitement to discrimination would have to be explored further. Did Charlie Hebdo promote discrimination against Muslims? Was the paper simply making pictures of Mohammed or was it attempting to foster intolerance of all Muslims? The new United Nations law makes a distinction.

The M’bala M’bala calls for a Jewish journalist to be killed in gas chambers and supporting terrorists who killed four innocent Jews are calls for direct and indirect incitement to hostility and violence.  Acting Palestinian Authority President Mamoud Abbas praise for martyrs who slaughtered innocents could also be called incitement to hostility and violence.

 Editing versus Censorship

Every media outlet edits their news stories. Papers constantly select only those parts of interviews that confirm a thesis it promotes to its readers. That is (theoretically) its right. Michael Moore edited interviews about global warming and the auto industry to convey a particular narrative that he wanted to portray in his movies. The public may ultimately view the half-stories they receive as accurate, half-accurate or completely inaccurate because of the known bias of the producers of the content.

However, no one considers editing to be a form of censorship or an infringement on the freedom of speech or press. If a paper opted to not publish a sports section, that is its right. If it crops a picture to focus on a particular image to reinforce its narrative, that is also its right. It may be bad journalism, but it is not censorship (and certainly not by a governmental authority).

In its ramble on free speech above, the New York Times highlighted the Israeli “conservative” newspaper Hamevaser’s choice to edit the picture of the Paris unity march to remove the female leaders. Hamevaser is run by and serves an ultra-Orthodox Jewish community (not politically conservative) that is against showing pictures of women due to their interpretation of modesty. Such action is a form of editing that newspapers engage in to meet the tastes of its readership. To somehow suggest that it is a form of Israeli censorship is absurd. Why would the Times possibly lump this example in with examples of freedom of speech and hate speech? It is completely off topic.


People in the western world rallied behind Charlie Hebdo because they see this situation as falling completely within the framework of free speech: it poked fun at a religion (a concept), not people (Muslims); and it did not call for any violence, rather the attacks came from a reaction from incensed Muslims. The case of M’bala M’bala has to do with inciting violence against people, and the Hamevaser picture has nothing at all to do with government censorship.

So how did the Times develop this list of irrelevant examples and not try to educate its readers (and actually confuse them with calling out “double standards”)?
